Terms & Conditions

1. The name of the promotion is “The Paint of Choice - Season After Season” Promotion 2023. Entrants must be at least 18 years of age at the time of entry. 

2. Employees, directors of BERGER PAINTS, respective advertising agencies – Saltwater Studios Caribbean Limited and The Limners and Bards Limited, members of the Betting, Gaming and Lotteries Commission (BGLC), participating hardware stores, as well as their immediate families (their parents, siblings, spouses and children) and are not eligible to participate in the Promotion.

3. Participants are allowed to enter as many times as they wish to increase their chances of winning, however, only one prize will be awarded per person in the bi-weekly draw. Each prize code can only be used once and any attempts thereafter with the same prize code will be void. 

4. The winner must present a valid I.D. when redeeming his or her prizes. The only valid I. D’sthat will be accepted are Voter’s I.D, Passport or Driver’s License. 

5. Non-cash prizes cannot be transferred, assigned, or redeemed for cash. Unless otherwise set forth herein, winners of the bi-weekly prizes shall be solely responsible for any and all costs not specifically described as part of the prize.

6. Each entrant may only receive a maximum of 5 Prize Codes per receipt, despite the volume purchased.

7. All terms and conditions will be published on the website www.bergerpaintscaribbean.comand on Berger Caribbean on Facebook. 

How to enter:

1. Shoppers will receive a physical “prize code” for every two (2) gallons of eligible Berger Paints purchased in participating hardware stores and the Colour Shop. Eligible products are Berger Everglow, Berger Weatherproof Ultra, Berger Royale Satin, Berger Royale Gloss, Berger 404, Berger 303 and Berger Rust Pro. Eligible products can be purchased in quarts, one gallon or 5-gallon pails. 

2. A physical prize code will be provided by either the Berger promoters or the supervisor of the participating store.

3. To enter for a chance to win the bi-weekly, grand, second, and third prizes entrants are required to: 

1. Visit the website www.bergerpaints.mobi and enter the prize code along with their contact information (name, email address and telephone number). The entrant’s name and phone number are mandatory, however, the email address is not. 

2. The entrants can also enter by sending a text message with the prize code along with their contact information to the number 876- 596-4369 on the Digicel network. Local SMS rates will apply.

3. All entrants must retain their receipts (proof of purchase) and prize code for collection of prizes.

4. The Promotion is valid from October 17, 2023, until 11:59 PM EST Friday, December 22, 2023. BERGER PAINTS is not responsible for late, incomplete, misdirected entries or printing errors. All entries received from ineligible entrants will be void. All entries become the property of Berger Paints.

5. Each prize code can only be used once and all subsequent entry submission with the same prize code will be void.

5. There will be seventy-three (73) total winners for this promotion.

6. An additional three (3) entries for each prize will then be selected to function as backup winners for each prize winner drawn.

7. The winners will be notified by telephone within three (3) working days from the date of the draw. Contact will be attempted by telephone two (2) times a day over a three (3) day period. If the winner cannot be contacted, another winner will be selected from the backup winners (in the order selected). In the event that no winner can be found, or a prize remains unclaimed after two (2) months, Berger Paints reserves the right to retain possession of the prizes. 

8. Supermarket vouchers and JPS light vouchers claimed after winner notification are valid for six (6) months. 

9. The names and photos of all winners will be published in the Press. 

10. BERGER PAINTS and or its representatives reserve the right, with the Authorisation of the Betting, Gaming and Lotteries Commission (BGLC), to examine identification and may choose to accept or deny awarding the prize based on the information presented. 

11. The Winners will be required to provide proof of their age and sign an Affidavit of Eligibility/Prize Acceptance and Release within five days of the notification to be confirmed as the winner. A Passport, Driver’s Licence or National ID will be the accepted forms of identification. If the winner declines to fulfil these conditions to collect the prize, their eligibility will be voided, and another winner will be chosen from the pool of backup winners. If the selected winner is unable to meet any of these criteria by the time the validity of the prize expires, their eligibility will be voided. 

12. If a winner does not redeem the prize in the manner described above, BERGER PAINTS reserves the right, with the Authorisation of the Betting, Gaming and Lotteries Commission, to disqualify such winner and to select a replacement winner from the remaining qualifying preselected backup entrants. BERGER PAINTS shall not be responsible for failed attempts to redeem a prize and no responsibility is assumed by BERGER PAINTS for any problem(s) associated with attempt(s) to redeem a prize(s). BERGER PAINTS is not responsible for any liabilities arising directly or indirectly from the award or use of the prizes. In claiming your prize, you acknowledge that BERGER PAINTS reserves the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner, across any advertising medium and for promotional purposes and without financial remuneration. 

13. Privacy / Use of Personal Information: BERGER PAINTS may gather Personal Information provided by entrants for the purposes of conducting and managing this contest and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as may be required by regulatory authorities. Personal Information may include but is not limited to: name (full name or first initial and last name), maiden name, email address, telephone number and physical address. This information is only collected when volunteered by an individual entering the contest. If the requested Personal Information is not provided, then an individual will not be able to participate in the contest. Each entrant gives permission to BERGER PAINTS to send promotional messages to them.

14. Claims: Under no circumstances will entrants be permitted to seek the award of damages, and hereby waives all rights to claim, punitive, incidental and consequential damages or any other damages, and to have damages multiplied or otherwise increased. All entrants agree to submit to the exclusive jurisdiction of the BERGER PAINTS location governing their jurisdiction and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of this promotion or official promotion rules.
